If you are relocating to the Triangle, NC area you may decide to rent an apartment or a home before you make a decision to purchase a home. Or if you are renting in the Triangle you may have questions regarding your current lease. I thought it might be helpful to share in my blog some answers to frequently asked questions (FAQ’s) regarding what is involved in renting residential real estate in North Carolina.
First of all, if a property is to be leased for less than three (3) years the agreement or contract does not have to be in writing. So if you are going to be a tenant or landlord, be careful of what you verbablly agree to do if you are not going to put the lease of the property in writing. A landlord-tenant relationship can be established by oral agreement if it includes the names of the landlord and tenant(s), the lease period (less than 3 years), the amount of the rent to be paid.
There is no universal lease agreement and the terms and conditions of a lease are not usually governed by legal statue, but there are a number of duties that are assumed by the tenant and landlord that cannot be negotiated away. We’ll look at some of these in my next blog.
