As I wrote in a previous blog, if you are considering relocating to the Triangle, NC you may have questions regarding how Raleigh area Homes are or apartments rented. Today I will answer some more questions regarding what is involved in renting residential real estate in North Carolina.
What is the law that governs residential rental properties in North Carolina?
The Residential Rental Agreements Act was passed for the purpose of requiring landlords to rent only “habitable†residential rental units to tenants.
What are the legally required duties of a landlord?
Comply with local building, zoning and housing codes. Keep the rental property in habitable condition and perform whatever repairs necessary to do so. All plumbing, sanitary, electrical, and heating and air conditioning, systems and appliances which the landlord has provided must be maintained in good, safe working order. Provide and maintain smoke detectors, including the installation of a new battery at the beginning of the tenant’s occupancy. Unless there is a written agreement to the contrary, the tenant is responsible to replace the batteries during the term of the lease. Keep the common areas of the property in safe condition.
